Mediation provides an opportunity for parties to resolve a dispute with the assistance of a neutral, trained mediator. Unlike a court proceeding, mediation is designed to encourage communication. The neutral mediator helps the parties identify areas of agreement and develop their own resolution.
A mediation session typically begins with an opening discussion. The mediator explains the process, answers questions, and establishes expectations for respectful and productive communication. Each party then has an opportunity to explain the dispute and describe what they hope to accomplish.
The mediator may meet with the parties together or in separate rooms. Private meetings, sometimes referred to as caucuses, allow parties to discuss concerns, evaluate options, and consider potential solutions confidentially. The mediator does not make decisions for the parties or determine who is right or wrong.
Throughout the session, the mediator helps clarify issues, identify common ground, and facilitate meaningful negotiations. The goal is to move the conversation from conflict toward practical solutions.
If an agreement is reached, the mediator can document the terms in writing for the parties to review and sign.
